Terms of Service.

Last updated: 2026-05-25. These terms are provisional and will be replaced by counsel-reviewed terms before public launch. Boutique engagements signed before that date receive the final terms as an addendum.

1. Parties

These terms govern the relationship between Recommence Ltd (trading as Ferendy), a company registered in England & Wales ("Studio") and the merchant commissioning a campaign ("Client").

2. Services

The Studio provides editorial visual production services as described on ferendy.com. Production methods are AI-augmented; see the AI Disclosure.

3. Payment

Single products and calibration weeks are paid in full upfront. Retainers are billed monthly in advance. Custom brand setups and collections-at-scale programmes are billed per contract.

4. Cancellation & refunds

Retainers can be cancelled anytime via the Stripe customer portal; the final cycle is honoured. A Client's first paid engagement, whether a single product or a calibration week, is refundable in full within 30 days of first delivery, with no conditions; requesting a revision does not affect this right. Where fees are refunded, the licence granted in section 5 ends for the images those fees paid for.

5. Asset license

Client receives an unlimited commercial license to delivered assets: perpetual, transferable, and sublicensable to the Client's marketing partners. The Studio retains the right to use delivered assets in lookbook samples only when the Client opts in via the brief. The licence is granted against payment: if the fees for a delivery are refunded under section 4, the licence to those images ends on refund and the Client stops using them.

6. AI use

Client acknowledges that production methods include AI-augmented generation. The Studio retains full creative direction and quality assurance. Client's reference material is not used to train models without explicit consent.

7. Liability

Studio's total liability is limited to fees paid by Client in the trailing twelve months.

8. Governing law

These terms are governed by the laws of England & Wales. Disputes are resolved through good-faith negotiation followed by arbitration via the LCIA.
