Welcome to the beta version of Ferendy (“Platform,” “we,” “us,” or “our”). Ferendy is not currently operated by a registered corporation, and these Terms of Service (“Terms” or “Legal Terms”) apply to your participation in our Beta release.

By accessing or using the Ferendy Beta application and services (collectively, “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinueuse of Ferendy.

1. BETA DISCLAIMER

1. Pre-Release Status
   The Services provided to you via TestFlight or any other Beta program are experimental and may contain bugs or other issues.
2. Feedback
   If you provide suggestions, bug reports, or other feedback (“Feedback”), you grant us the right to use such Feedback without restriction or obligation to you.
3. No Guarantee of Performance
   Because this is pre-release software, we make no promises regarding functionality, performance, or reliability.
4. Data Collection
   We may collect crash logs, analytics, and usage data to help us identify bugs and improve our Services. See our [Privacy Policy] for details.
5. Limitation of Liability
   You use the Beta at your own risk. We shall not be liable for any damages arising out of or related to your use of the Beta.

2. ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) to participate in the Beta. If you are under 18, you are prohibited from using or registering for the Services.

3. USER ACCOUNTS

1. Registration
   You may need to create an account by providing accurate, current, and complete information.
2. Responsibility
   You are responsible for all activities under your account and for safeguarding your login credentials.
3. Termination
   We may suspend or terminate your account at any time if we suspect a breach of these Terms or any illegal or inappropriate conduct.

4. USER CONDUCT & PROHIBITED ACTIVITIES

You agree not to:

1. Use Ferendy for any unlawful or unauthorized purpose.
2. Upload or transmit harmful code, viruses, or other disruptive elements.
3. Use AI Bots or Automated Tools. The use of any automated scripts, bots, or AI agents (other than those expressly provided or authorized by Ferendy itself) is strictly prohibited. You must only access and use the Services in a human capacity or as otherwise expressly permitted by Ferendy.
4. Impersonate or misrepresent your affiliation with any person or entity, including Ferendy.
5. Engage in fraudulent, abusive, or harassing behavior toward other users or third parties.

Inappropriate Behavior
We reserve the right, at our sole discretion, to deactivate or remove any user whose behavior, content, or interaction we deem inappropriate, offensive, or in violation of these Terms or applicable law. This may include, but is not limited to, posting defamatory content, engaging in hate speech, harassment, threats, or otherwise disrupting the platform.

5. INTELLECTUAL PROPERTY

1. User Content
   You may post product recommendations, images, or comments (“User Content”). By posting, you grant Ferendy a worldwide, royalty-free, irrevocable license to display, use, and reproduce that content as needed to operate or promote the Services.
2. Platform Content
   All other content, including trademarks, logos, and code, belong to Ferendy or its licensors. You shall not copy, reverse engineer, or create derivative works of any portion of Ferendy’s Services without our express consent.

6. PRIVACY & DATA

Your use of Ferendy is subject to our [Privacy Policy]. By using Ferendy, you agree to our data collection and handling practices, including any additional Beta analytics or crash reports.

7. DISCLAIMER OF WARRANTIES

AS-IS & AS-AVAILABLE
Ferendy is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Beta will be error-free, uninterrupted, or secure, nor that defects will be corrected.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use (or inability to use) the Beta or any aspect of Ferendy. In no event will our total liability exceed the amount you paid (if any) for accessing the Beta.

9. MODIFICATIONS & TERMINATION

We reserve the right to modify, suspend, or discontinue any aspect of the Beta or these Terms at any time, without notice. By continuing to use Ferendy after we post changes, you accept the modified Terms.

10. GOVERNING LAW

These Terms and any dispute arising from them shall be governed by and construed under the laws of the United Kingdom, without regard to conflict-of-law principles.
